California: Ruling Against Marijuana Clubs
Although California's Compassionate Use Act of 1996 permits patients to obtain and use marijuana when prescribed the drug by a doctor, federal law prohibits possession of marijuana for any purpose. The Justice Department sued the clubs in 1998 to stop them from violating federal law by supplying patients with marijuana. In 2002 a federal trial judge imposed the injunction that was upheld by the Ninth Circuit in last week's ruling.
